Renting out your home to tourists, registration

Are you renting out your entire home or 1 or 2 rooms in your home to tourists, for example, through Airbnb or Booking.com? Since 1 October 2022, you must register and report your rental activity. You can read all about it on this page. Use the buttons on the right to register for free or report your rental.

Who must register

Anyone renting out their whole property or 1 or 2 rooms must register their property. For whole properties rented out, reporting is also mandatory. This obligation does not apply to tourist rentals from a building or premises that is not a residence, such as hotels or guest houses or holiday homes (on a campsite or holiday park).

Step 1: one-off registration

Using the 'free one-off registration' button, you can register your property and request a registration number. You can log in with DigiD, eHerkenning or eIDAS. Registration is free and only needs to be done once. You will receive the number by email immediately, but you can only use it after your registration has been approved by the municipality. This process takes about 2 weeks.

You must use the registration number you receive in every advertisement. Failure to do so may result in a fine.

Step 2: report rental in advance

Are you renting out your entire property? This is allowed for a maximum of 60 nights per year. You must report each rental in advance to us. Use the 'Report a rental' button to do so.

You can cancel a notification up to one day before the rental. If you need to cancel on the day of the rental, report it to twvm [at] maastricht.nl.

Why we regulate holiday rentals

The housing market in Maastricht is failing. Maastricht wants to help people who are looking for a home by regulating holiday rental of flats and houses. Renting out your home or rooms in your home to tourists is only allowed under certain conditions, and you are required to register.

As of 1 October 2022, the Huisvestingsverordening Gemeente Maastricht 2022 (housing ordinance) has come into effect, which includes registration and reporting requirements.

Costs

You can register and report rental free of charge. Failure to do so may result in a fine. You must pay tourist tax if you rent out your property or rooms in your property to tourists.

  • If you are on holiday yourself, for example, Maastricht allows you to rent out your home to tourists under certain conditions.

    Conditions
    • You must have a registration number. 
    • You must use the registration number obtained in each advertisement.
    • You may rent out your home to tourists for a maximum total of 60 nights per year. Each time you rent out your home, you must report this to us.
    • You may rent out your home to tourists for a maximum of 4 consecutive weeks.
    • You must pay tourist tax.
    • Your accommodation must be fireproof, there must be smoke detectors and the accommodation must meet the requirements of the Buildings Decree.
    • The rental must not cause a nuisance: you must do everything possible to prevent this.
    • If you are not the owner or if your home is part of a building where a Vereniging van Eigenaren (Owners' Association) is active, the owner or the Vereniging van Eigenaren must give you permission first.
    Not for company homes and housing association homes

    Renting your home to tourists is not allowed if it is a company home. A company home is a residence in or near a business building or on a business site for one person or a family who must live there because of the purpose of the business building or site. Similarly, you may not rent out your home to tourists if your home belongs to a housing association.

    2 tips

    • You must report income from holiday rentals to the Belastingdienst (tax authorities).
    • Always inform the insurance company where you have taken out your building insurance, contents insurance and liability insurance about renting out your home to tourists.
  • Most zoning plans state that you may rent out a maximum of 2 rooms to tourists. However, this is subject to several conditions. For example, you must be the owner and the main tenant and the building must be intended for housing. The conditions are included in the zoning plan as the 'guest house regulation'. If possible, you are allowed to rent out rooms for more than 60 nights a year. Applying for a registration number is also mandatory in this case. You must use the registration number you get in every advertisement.

  • I previously participated in the pilot "Tourist Home Rental. Do the rules also apply to me?

    Yes, the registration and reporting obligation also applies to you. You register once again and receive a new registration number. This new registration number will appear in all your advertisements. You also make rental notifications through the system.

    Why do I have to pay tourist tax and how does it work?

    You must pay tourist tax to the Belastingsamenwerking Gemeenten en Waterschappen (BsGW) if you are a business owner and if you have property where tourists stay overnight.

    Paying tourist tax is required if:

    • your guests pay for an overnight stay
    • your guests are not registered in the gemeente Maastricht (the municipality of Maastricht)

    How will the requirements affect current homeowners renting out (part of) their home to tourists?

    Current homeowners known to us received an email asking them to register once using the registration platform. You must apply for a registration number before 1 April 2023 at the latest, and include the number in any publication, advertisement or listing offering their property or room(s) for holiday rental.

    Please note that people who rent out their entire property are also subject to a notification requirement for each rental.

    How will the requirements affect new homeowners wanting to rent out their home to tourists?

    Every new homeowner wanting to rent out (part) of their home to tourists must register once. You will get a registration number that you must mention when offering the property or room(s) for holiday rental.

    Who can apply for a registration number or report rentals?

    The person offering the home or room(s) for holiday rental must apply for the registration number and report rentals.

    Can I apply for a registration number for someone else?

    This is only possible if you are offering the property or room(s) in the property for holiday rental.

    What happens if I do not have a registration number or fail to report my rentals?

    You need a registration number to rent out (part of) your home to tourists. This is compulsory. Renting out your home without a registration number is considered an offence, in which case we:

    • can impose a penalty (and a fine if you do not register),
    • use administrative coercion (closing the property for rental if you do not register) or
    • impose an administrative fine directly. You can find the administrative fines in the table below.

    How will you ensure that homeowners correctly report their rentals and number of nights of each rental?

    Once you have registered your property, you will receive a registration number by email. You can only use this number once your registration has been approved by the municipality, which usually takes 2 weeks. The municipality will regularly monitor registrations and rental reports to ensure compliance. Homeowners who rent out their entire property are allowed to do so for a maximum of 60 nights per year. If the maximum number of nights is getting close, landlords will receive a preliminary warning. Enforcement action will be taken if the limit is exceeded.
