Your rights

The General Data Protection Regulation (Algemene Verordening Gegevensbescherming) gives you various rights. These rights are explained briefly below.

Legal representation

Are you under guardianship? Then your legal representative can also submit requests on your behalf.

Minor children

As a parent you can rely on the rights under the General Data Protection Regulation for your children up to 16 years of age. The Municipality of Maastricht may ask for proof that you have parental authority over the child or the children for whom you submit a request.

  • You can submit a request to find out which of your personal data are known to the Municipality of Maastricht. You will receive an overview including:

    • the categories of personal data
    • the purpose for which the data is used
    • the origin of the data
    • the recipients of the data

    Submitting a request

    Please use one of these forms to submit a general access request:

    No right of access

    We can deny your request for access or deny part of your request, for instance if this is necessary for the protection of the data of another person. We can also deny a request for access if this is manifestly unfounded or excessive.

    Our decision

    We will send you a response to your request within one month. We strive to give you a final decision on your request within this period. If this is not possible, we may extend the response time by two months.

  • If you have found inaccuracies in your personal data, you can submit a request to the Municipality of Maastricht for the rectification, supplementation, or blocking of your data. You can do the same if the data is incomplete, if you believe that the data are not relevant to the purpose with which they were collected, or if the data are otherwise used by the Municipality of Maastricht in breach of the law. We may ask you to provide us with supporting documents.

    Submitting a request

    Please use one of these forms to submit a rectification request:

    No right to rectification

    You cannot use the right to rectification in respect of data in public registers established by law, such as the Personal Records Database (Basisregistratie Personen). You can, however, submit a request to your local municipality to rectify your data in the Personal Records Database.

    In addition, we can refuse a request for rectification if we need the personal data, for instance in connection with fulfilling a task carried out in the public interest or the exercise of public authority.

    Our decision

    We will send you a response to your request within one month. We strive to give you a final decision on your request within this period. If this is not possible, we may extend the response time by two months.

  • You can ask the Municipality of Maastricht to stop processing your data. This is the right to object. You can only exercise this right if your data is collected for commercial purposes or if you have special personal reasons to object to the processing of your personal data.

  • In specific situations, the Municipality of Maastricht is not required to honour your rights. This is only possible if there is a good reason for this, for instance in connection with national security, the protection of the data subject or the protection of the rights and freedoms of other persons, and the prevention, detection, or prosecution of criminal offences.
